SUB2r, INC. WARRANTY POLICY

SUB2r, Inc. (“SUB2r”) warrants the SUB2r, Inc.-branded products contained in the original packaging (“SUB2r Product”) against defects in materials and workmanship for a period of ONE (1) YEAR from the date of original retail purchase by the end-user purchaser ("Warranty Period"). Warranty is only valid with a proof of purchase that clearly shows the purchase date. Alteration of products will void warranty. SUB2r’s limited warranty is nontransferable and is limited to the original purchaser.
APPAREL WARRANTY POLICY
All SUB2r apparel is warranted against defects in material or workmanship for 30 days from the date of purchase. The warranty does not cover any defects due to improper fit. Warranty is only valid with a proof of purchase that clearly shows the purchase date. Alteration of products will void warranty. SUB2r’s limited warranty is nontransferable and is limited to the original purchaser.
WHAT THIS LIMITED WARRANTY DOES NOT COVER
This Warranty does not apply to any non-SUB2r-branded Products, even if packaged or sold with SUB2r Products. Manufacturers, suppliers, or publishers, other than SUB2r, Inc. may provide their own warranties to you – please contact them for further information. SUB2r is not responsible for damage arising from failure to follow instructions relating to the SUB2r Products’ use.
SUB2r does not guarantee or warrant that its products are compatible with any product not manufactured by SUB2r. SUB2r shall not be responsible for any damage to third party products as a result of use of SUB2r Products. In addition, SUB2r shall not be responsible for any damage caused to SUB2r Products as a result of the use of any third-party products.
This Warranty does not apply: (a) loss of product or any of the accessories; (b) to cosmetic damage, including but not limited to scratches, stains, dents and broken plastic on ports; (c) to damage caused by use with another product; (d) to damage caused by accident, abuse, misuse, liquid contact, fire, use of chemicals, earthquake or other external cause; (e) to damage caused by operating the SUB2r Product outside SUB2r’s published guidelines; (f) to a SUB2r Product that has been modified to alter functionality or capability; (g) to defects caused by normal wear and tear or otherwise due to the normal aging of the SUB2r Product; (h) if any serial number has been removed or defaced from the SUB2r product; or (i) to consumable parts (such as batteries).
If during the Warranty Period you submit a valid claim to SUB2r, SUB2r will, at its option, (i) repair the SUB2r Product using new or previously used parts that are equivalent to new in performance and reliability, (ii) replace the SUB2r Product with a device that is at least functionally equivalent to the SUB2r Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or (iii) exchange the SUB2r Product for a refund of your purchase price.
A replacement part or product assumes the remaining term of the Warranty or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you. When a SUB2r Product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes SUB2’s property.
Returns or replacements of parts and/or products may be subject to shipping, handling, replacement and/or restocking fees.
HOW TO OBTAIN WARRANTY SERVICE
Please access and review the online help resources before seeking warranty service. If that does not resolve your problem, please contact SUB2r to determine whether your problem qualifies under warranty coverage, and if it does, you will be issued RMA (Return Merchandise Authorization) number. Please do not return anything to us without an RMA, as we will not be responsible for that return.
Prepare a package to return to SUB2r; write your RMA number on the outside of the box and send to:

SUB2r may cover shipping costs at its sole discretion.
DISCLAIMER OF WARRANTIES
EXCEPT AS STATED ABOVE IN THIS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUB2R DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES AND CONDITIONS WITH RESPECT TO THE PRODUCT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUB2R ALSO LIMITS THE DURATION OF ANY APPLICABLE IMPLIED WARRANTIES OR CONDITIONS TO THE DURATION OF THIS LIMITED WARRANTY.
LIMITATION OF DAMAGES
IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, IN NO EVENT WILL SUB2R BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES, INCLUDING ANY DAMAGES FOR LOST DATA OR LOST PROFITS, ARISING FROM OR RELATING TO THIS LIMITED WARRANTY OR THE PRODUCT, AND SUB2R’S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THIS LIMITED WARRANTY OR THE PRODUCT WILL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THE PRODUCT BY THE ORIGINAL PURCHASER.
LIMITATION OF LIABILITY
ALL PRODUCT INFORMATION IS PROVIDED FOR YOUR CONVENIENCE,“AS IS”, AND “AS AVAILABLE”. YOU USE ALL PRODUCT INFORMATION, THE SERVICES, AND THE PRODUCT AT YOUR OWN DISCRETION AND RISK. YOU WILL BE SOLELY RESPONSIBLE FOR (AND SUB2R DISCLAIMS) ANY AND ALL LOSS, LIABILITY, OR DAMAGES, INCLUDING TO YOUR PRODUCT PERIPHERALS, COMPUTER, AND ALL OTHER ITEMS AND PETS, RESULTING FROM YOUR USE OF THE PRODUCT INFORMATION, SERVICES, OR PRODUCT.
YOUR RIGHTS AND THIS LIMITED WARRANTY
This Limited Warranty gives you specific legal rights. You may also have other legal rights that vary by state, province, or jurisdiction. Likewise, some of the limitations in this Limited Warranty may not apply in certain states. The terms of this Limited Warranty will apply to the extent permitted by applicable law. For a full description of your legal rights, you should refer to the laws applicable in your jurisdiction and you may wish to contact a relevant consumer advisory service.
This Warranty is governed by the laws of the State of California and by United States federal law without regard to conflicts of laws principles. Any litigation relating to this warranty shall be subject to the exclusive jurisdiction of the state or federal courts in San Francisco, California, U.S.A. The United Nations Convention on the International Sale of Goods is expressly excluded from application to this Warranty.
